State of Georgia v. C.L.B (2024)

Superior Court of Gwinnett County; Indictment #: 23-B-00631-3

Felony theft charges dismissed by State prior to start of jury trial.

Summary: This case originated from an alleged theft of a 2017 Chevrolet Silverado. On November 17, 2022, C.L.B was spotted entering a vehicle that had been reported stolen from a construction company located in Fayette County, Georgia. Police detained C.L.B. and determined that he was the person who was driving the vehicle prior to law enforcement’s arrival at the scene. C.L.B. provided statements to police indicating that he had received the vehicle from a friend and was advised by his friend would that the title to the vehicle would be transferred to C.L.B. C.L.B. was arrested and ultimately charged with Theft by Receiving Stolen Property (felony). Prior to the start of the jury trial, Attorney Dominko Rumph was able to demonstrate to the District Attorney’s Office that the State would have insufficient evidence to show the specific knowledge required to convict C.L.B. of Theft by Receiving Stolen Property. As a result, the District Attorney’s Office dismissed the charge against C.L.B.
