State of Georgia v. M.R.Y (2023)
Superior Court of Gwinnett County; Indictment #: 23-B-00204-4
Drug charges dismissed after filing Motion to Suppress Evidence.
Summary: This case originates from a September 9, 2022 traffic stop during which M.R.Y. was a front seat passenger. Officers purportedly initiated a traffic stop for the purpose of addressing a tag light violation. After completing the mission for the traffic stop, officers unlawfully extended the traffic stop for the purpose of searching for contraband. After ordering both occupants out of the vehicle, officers refused to allow M.R.Y. to leave the unlawful detention unless he allowed an officer to search his person. After searching M.R.Y.’s person, police located suspected cocaine and placed him under arrest. After reviewing the case, Attorney Dominko Rumph filed a Motion to Suppress Evidence Obtained from Illegal Detention, Search, and Seizure. After reviewing the Motion and evidence available, the District Attorney’s Office dismissed all charges against and restricted the charges from his record.
